Frequently asked questions

What clients usually ask us

  • I have been summoned as a person under investigation: what does it mean?

That a court is investigating events in which you may have been involved, not that you have been charged with anything. You have the right to know what you are being investigated for, to remain silent and to have a lawyer from the very first moment. Most importantly, do not go to give a statement without first preparing it with your lawyer.

  • Can a company be criminally liable?

Yes. In Spain, legal entities can be criminally liable for certain offences — including tax fraud, money laundering, fraud and planning offences — committed for their benefit by their managers or by poorly supervised employees. A properly implemented crime prevention (compliance) programme can exempt it from liability or reduce it. We advise the company and defend it when proceedings are opened.

  • When is not paying tax a crime?

When the evaded tax exceeds €120,000 per tax and year and there is concealment or deceit; below that, it is an administrative offence. Voluntarily regularising before the tax authorities start proceedings can rule out criminal liability. For any inspection that might approach that limit, a criminal lawyer and a tax lawyer should be involved from the start.

  • Can I act as a private prosecutor in criminal proceedings?

Yes. The victim of a crime can join the proceedings as a private prosecutor (acusación particular): propose evidence, take part in the trial and claim compensation for damages. It is common in cases of fraud, misappropriation or breach of fiduciary duty, where recovering what was lost largely depends on acting early to secure the offender's assets.
